Terms of Service

1. Acceptance

By accessing or using Timekeepur Labs ("Service"), you agree to these Terms of Service. If you do not agree, do not use the Service.

2. Service Description

Timekeepur Labs provides agent swarm simulations, strategy diagnostics, and product and engineering services. The Service uses generative AI to observe, reflect, and plan - stress-testing strategy through emergent simulation.

3. Account & Eligibility

You must be at least 13 years of age to create an account or use the Service in any capacity. We do not knowingly collect personal information from children under 13. If we learn that a user is under 13, we will promptly delete the account and all associated data.

Users aged 13 through 17 may use the Service through our Educator Program with a valid school-issued email address (.edu, district .org, or equivalent). These accounts are individual Pro accounts provisioned directly to the student. Timekeepur Labs does not act as a "school official" under FERPA and does not enter into agreements that designate us as such unless an Enterprise agreement is executed.

Users 18 and older may create accounts independently and are responsible for maintaining the confidentiality of their account credentials.

3A. Educator Program

The Educator Program provides individual Pro accounts at no cost to verified students aged 13 and older enrolled in K-12 or post-secondary STEM, CTE, or engineering programs. Educator Program accounts are consumer accounts governed by these Terms; they are not institutional accounts and are not provisioned by or on behalf of a school district.

Teachers may request welcome packets and onboarding materials but do not receive administrative control over student accounts through the Educator Program. Full administrator access, district-wide deployments, student data agreements, and compliance SLAs for FERPA (Family Educational Rights and Privacy Act), COPPA (Children's Online Privacy Protection Act), and SOPPA (Student Online Personal Protection Act) are available exclusively under an Enterprise agreement. Contact us to initiate an Enterprise engagement.

4. Acceptable Use

You agree not to use the Service for any unlawful purpose, to violate any applicable laws, to infringe on others' rights, or to transmit malicious code. We may suspend or terminate accounts that violate these terms.

5. Intellectual Property

You retain ownership of content you submit. By using the Service, you grant us a limited license to process, store, and display your content solely to provide the Service. Our Service, including its design and technology, remains our property.

6. Payment

Paid plans are billed via Stripe. Fees are non-refundable except as required by law or as stated in our refund policy. We may change pricing with notice; continued use after changes constitutes acceptance.

7. Termination

You may close your account at any time. We may suspend or terminate access for violations or at our discretion. Upon termination, we will delete your data in accordance with our Privacy Policy.

8. Disclaimers

The Service and AI outputs are provided "as is." AI-generated content may be inaccurate or incomplete. We do not provide professional legal, financial, or medical advice. Use at your own risk.

9. Limitation of Liability

To the maximum extent permitted by law, Timekeepur Labs shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

10. Governing Law

These terms are governed by the laws of the State of Illinois, USA, without regard to conflict of law principles.
